Neither eSitefactory Web Site Designs or eSitefactory Corporation, nor any of its divisions, subsidiaries, officers, employees, agents or representatives shall be liable for any damages whatsoever whether direct, indirect, consequential or incidental arising out of the use of this web site or its products, services or promotions. Damages and liability is expressly limited to fees paid by the customer.

The Customer agrees that rights of usage are exclusively limited to the intended web site within the web site collection. The images may not be used for any other purpose, resold, loaned or transferred. The rights of usage is granted only upon full payment of web site designs or associated services including revisions, changes, options and modifications. NO OWNERSHIP OF IMAGES INCORPORATED INTO WEB SITE DESIGNS IS GRANTED. 

 indemnity/copyright violation of customer provided images or content

The customer agrees to hold eSitefactory Corporation or any of its divisions, officers, employees, agents or representatives harmless against any claims, damages or liability of any kind arising from the incorporation of customer provided images or content into its selected web site design. It is the customer's legal responsibility to ensure that no provided image is copyright-owned by a third-party and prohibits usage or incorporation into eSitefactory produced marketing media including web sites. 

Only upon full payment of relative fees, eSitefactory only extends a right of usage of web site designs and productions including design, development and applications. Ownership of such remains the exclusive ownership of eSitefactory Corporation, its divisions, Vendors or Alliance Partners. Right of usage may not be transferred, loaned, sold or leased and may not be re-adapted for any other purpose. 

Any links from this web site to third-party web sites or any recommendations of third-party providers is intended for customer convenience only. We do not endorse, warrantee, or guarantee any third-party products or services. Please seek advice of professionals as appropriate regarding opinions or recommendations made by us to make any evaluations and usage determination. The customer makes its own evaluations and purchase decisions. 

Upon providing credit card information for payment and payment security, the customer grants eSitefactory Corporation and its divisions the ongoing right to apply its fees to such provided valid credit card. eSitefactory Corporation or its divisions will securely maintain such information. The customer agrees to notify eSitefactory Corporation upon any termination of provided credit cards making such invalid.
